Mesa police officer indicted in road-rage incident

PHOENIX (AP) — A Mesa policeman has been indicted on aggravated assault charges stemming from a road-rage incident.

Police say Sgt. Mike Duke is scheduled to appear Aug. 22 before a commissioner.

The 19-year veteran has applied for a medical retirement and his application is pending before the city's retirement board.

Police officials said at a news conference last month that they believe the 42-year-old Duke landed the first blow during a confrontation with two brothers on Dec. 18.

Police had arrested Randy and Jerry Smyers, but dropped the charges and asked Scottsdale police to investigate to avoid the appearance of a conflict of interest.

Duke was off-duty and driving to an urgent-care center in his minivan with his three sons when the incident occurred in northeast Mesa.
