RCSCW reviews CC&R enforcement options
Comments 0 | Recommend 0The governing board of the Recreation Centers of Sun City West will hear a presentation regarding CC&R violations at its upcoming regular meeting May 22.
General Manager Mike Whiting will present various options to board members about who should be enforcing violations of Covenants, Conditions and Restrictions, and what advantages and disadvantages each option would offer.
Currently, the board has an agreement with the Property Owners and Residents Association to investigate potential infractions. Generally, PORA investigates a potential violation, works with a homeowner to resolve the situation and then works with the RCSCW legal affairs committee, which reports to the board at the resolution of the incident.
In recent months, residents have criticized the system and questioned whether it follows the community's bylaws.
Resident Richard Ahlgren, a former lawyer, filed a formal request in March asking the board to comply with the organization's bylaws in the handling of suspected violations. His motion suggested the board create a committee or otherwise enforce CC&Rs within the organization, rather than doling the responsibility to another organization.
The meeting will be at 9 a.m. in the R.H. Johnson Social Hall in Sun City West.
